May 20th saw a Moorpark embezzlement suspect arrested by authorities. A property manager from Moorpark was arrested after it was alleged that he embezzled over $40,000. The investigation started in March when a group of ranchers came to police to report that they believed they had been the victims of embezzlement by their property management company. After investigating for a few weeks, authorities determined that the property management company owner, M. Mobley, was a suspect.
Over the course of the investigation, detectives learned that Mobley had embezzled at least $40,000 over the course of a few years and obscured the thefts by falsifying bank records.
After serving search warrants at two properties owned by the suspect, during which they were able to obtain evidence, authorities arrested the suspect on May 20th on suspicion of felony grand theft.
California Penal Code 503 covers California’s embezzlement laws and describes the crime as unlawfully taking property that was entrusted to you, with the intention to deprive the rightful owner of use of the property. It can be charged as either a misdemeanor or a felony depending on the value of the embezzled property. If the value is greater than $950, the crime can be charged as a felony. If the value is less than $950, it can only be charged as a misdemeanor.
A few examples of embezzlement include:
- Taking money from the till while running a cash register
- The treasurer of an organization taking some of the money they are in charge of
- An investor taking clients’ money to pay off debt
Since the amount that was stolen in the case above is well over $950, the suspect will be facing felony charges.
