Three Bakersfield residents were recently arrested which took place during an ongoing investigation. Two males, 19 and 41, were arrested and charged with transporting and selling a controlled substance, both felonies, while a female, 20, was charged with misdemeanor possession of concentrated cannabis. Bail for the two men is set at $30,000, and they’re currently being held at the Santa Clarita Sheriff Station.
The felony drug charges, transporting a controlled substance and selling a controlled substance fall under California Health and Safety Codes 11352 HS and 11351 HS, respectively. Transporting a controlled substance, 11351 HS, is a felony and can easily described as being in possession of a controlled substance and moving it from one place to another. The punishments include 1-5 years in county jail, probation, and a fine of up to $20,000. If the substance was moved over two county lines, though, the potential time in jail is increased to a maximum of 9 years.
Selling a controlled substance, 11352 HS, also a felony, is usually charged when someone is caught with possession of a large amount of a controlled substance. The penalties are similar to those of violating 11351 HS, and include probation, up to 4-years in county jail and a maximum fine of $1,000.
The female in this case was lucky. Her possession of concentrated cannabis could, up until recently, have been charged as a felony. However, because the amount was small, it was charged as a misdemeanor under new guidelines stemming from proposition 47.
